Carlo Casini (UDC/PPE) Presidente della Commissione Affari Costituzionali del Parlamento Europeo
Lo so, quando la presidenza della Commissione Affari Costituzionali (Afco), competente a decidere sul divieto di accesso dei condannati al Parlamento Europeo, è passata da un socialista tedesco (Jo leinen) ad un democristiano italiano (Carlo Casini) qualche elemento per diffidare c’era. Ma mi son detto che magari avevamo trovato una mosca bianca e che di lui ci si poteva fidare. Tanto che nell’ultimo post lo scorso 28 Luglio scrivevo
Noi restiamo fiduciosi che il nuovo presidente Carlo Casini faccia proprio l’auspicio del suo predecessore Leinen mettendo all’ordine del giorno delle prossime sedute del Comitato l’emendamento all’Atto del 1976 nel senso da noi richiesto (incandidabilità/ineleggibilità dei condannati).
E invece no, seppur ne lui ne nessun altro membro della Commissione Afco abbia risposto al sottoscritto, Carlo Casini lo ha fatto in modo indiretto. Come ricorderete nei post precedenti vi ho invitato a rivolgervi al Parlamento Europeo sia scrivendo alla Commissione Affari Costituzionali che alla Commissione Petizioni. Da quanto so moltissimi di voi lo hanno fatto e presto riceveranno una risposta.
Al sottoscritto, che ha inviato la petizione lo scorso Marzo, la Commissione Petizioni ha risposto ad Agosto informandomi di aver sottoposto le questioni sollevate alla commissione competente per materia, inviando la petizione (417/2009) alla Commissione Affari Costituzionali.
Lo ha fatto lo stesso giorno, il 3 Agosto scorso, inserendo nella lettera che la accompagna
“l’auspicio che questa possa essere utilizzata, come contributo ai lavori della commissione Affari Costituzionali in questo settore”.
E a questo punto arriva la risposta del Presidente della Commissione Afco On. Carlo Casini (UDC/PPE) che appena 3 giorni fa, il 9 Settembre, risponde alla Commissione Petizioni scrivendo che la Commissione da lui presieduta
non è in grado di proporre rimedi e non darà alcun seguito alla petizione ricevuta.
Più chiaro di così non poteva essere. Casini si arrampica sugli specchi pur di non affrontare il problema, contraddicendo autorevoli pronunce come:
- La Commissione petizioni che gli aveva inviato la petizione proprio in quanto il tema sollevato ricade sotto la competenza e responsabilità della Commissione Afco da lui presieduta;
-L’ex Presidente del Parlamento Europeo Hans-Gert Poettering che lo scorso Febbraio, in risposta ad una mia richiesta di informazioni sul tema, aveva richiamato la mia attenzione sulla Raccomandazione del 30 Maggio 2002 invitandomi, nel caso non avessi ritenuto sufficienti gli emendamenti apportati a contattare i membri della Commissione Affari Costituzionali.
- L’ex presidente della Commissione Afco, predecessore di Casini, il socialista tedesco Jo Leinen che ad Aprile mi scriveva :
il problema dei condannati potrebbe benissimo essere preso in considerazione, inserendolo nella modifica all’Atto intrapresa lo scorso Autunno con riguardo all’età minima per elettori e candidati
- Il Consiglio dell’Unione Europea che mi conferma che:
L’atto relativo all’elezione dei membri del Parlamento europeo a suffragio universale diretto può essere modificato su iniziativa del Parlamento europeo a norma dell’articolo 190 (4) del trattato CE. Il Consiglio considererà e adotterà eventuali modifiche all’Atto del 1976 sulla base di un progetto del Parlamento Europeo. Attualmente, non vi è alcun progetto all’attenzione del Consiglio in merito alla modifica dell’Atto del 1976.
Ciò a riprova di come nessuno più della Commissione Afco al Parlamento Europeo può affrontare la questione e bandire i condannati attraverso una modifica all’Atto del 1976 che regolamenta l’elezione degli eurodeputati.
Ma chi è Carlo Casini? Classe 1935, ex magistrato di Cassazione, siede tra i banchi della Camera dal 1979. Nel fronte antiabortista sin dagli anni 70 è il Presidente del “Movimento per la Vita“ .
Agli inizi degli anni 80, quando si discuteva la legge sulla violenza sessuale Carlo Casini sosteneva il vecchio principio del codice penale fascista secondo il quale lo stupro era un reato contro la morale e non contro la persona, come recitava l’articolo uno della nuova legge allora in discussione. Recentemente, si è espresso duramente contro la pillola Ru486 e le donne che la prendono. Miokarma riflette sul suo blog: “Una donna violentata non aveva diritto allo status di persona, un embrione invece si.”
Certamente a uno che come compagni di partito (Udc) ha vari condannati (su tutti Salvatore Cuffaro, 5 anni in primo grado per favoreggiamento aggravato di alcuni mafiosi), la nostra iniziativa per “pulire” il Parlamento Europeo dai condannati si è capito non piace. Ma non per questo ci fermeremo, anzi! Useremo tutti gli strumenti democratici perché, almeno in Europa, le cose cambino.
Speriamo che gli eurodeputati che finora hanno aderito a questa iniziativa: Vincenzo Iovine, Pino Arlacchi, Niccolò Rinaldi, Sonia Alfano (IDV/ALDE), Andrew Duff, Graham Watson, Alexander Alvaro (ALDE), Rita Borsellino (PD/S&D), Roberta Angelilli (PDL/PPE) si mobilitino insieme a noi.
Finora solo un capogruppo del Parlamento Europeo ha risposto al nostro appello. Si tratta di Nigel Farage, capogruppo dell’ELD (Europa della Libertà e della Democrazia) che in poche parole scrive
L”Unione Europea è un’organizzazione criminale che non può essere riformata quindi va abolita.
Farage, leader del Partito Inglese UKIP, lo stesso che aveva espulso l’eurodeputato inglese condannato Ashley Mote di cui scrivevo qualche post fa, ora, per coerenza, si è unito in matrimonio con la Lega Nord del condannato Borghezio con il solo fine di poter raggiungere il numero di 25 eurodeputati necessario per formare un gruppo al Parlamento Europeo (l’ELD appunto) ed evitare di finire tra i “Non Iscritti”. Non riesco a non sorridere pensando a questi personaggi che dicono di voler “abolire l’Europa” e nel frattempo fanno di tutto per godere di quei privilegi che contestano a parole.
Ora più che mai è quindi necessario far sentire la nostra voce scrivendo ai membri della Commissione Affari Costituzionali del Parlamento Europeo. Gli Italiani presenti in commissione oltre a Carlo Casini sono Roberto Gualtieri (PD/S&D) e Potito Salatto (PDL/PPE). Nessun membro dell’IDV ma per loro ci sono i colleghi di gruppo Andrew Duff, Stanimir Ilchev e Guy Verhofstadt, leader del gruppo ALDE.

- Aldo Patriciello (EPP):
Convicted to four months for illegal financing: in the beginning of the 90s he gave 16 million of italian lires to a “political friend”.
-Mario Borghezio (EFD):
In 2005, he was found guilty of arson, for having set fire to the belongings of some immigrants sleeping under a bridge in Turin during a vigilante raid, sentenced to 2 months and 20 days imprisonment, commuted to a fine of 3.040 euros.
- Vito Bonsignore (EPP):
Convicted to 2 years of prison for attempted bribery for the contract the hospital of the italian city of Asti.
- Nick Griffin (NI):
Convicted for incitement to racial hatred for material denying the Holocaust.
- Jean Marie Le Pen (NI):
Convicted several times for racism or inciting racial hatred.Please note that this issue falls within the public preferences for the priorities of this legislative term as evidenced by the focus survey published on April 09 the European Parliament website (Page 12: “A large percentage of Italians want the candidate eligibility criteria to be revised; this was also the case with most Europeans..”)
For this reason I’m addressing to you, trusting in your sensitivity toward this problem and asking you to handle to amend the Act to reach the goal above described, conforming the forecasts for all the European Members of Parliament, in a way that in the future there will be no more convicted people in the European Parliament, as it still happens, unfortunately, these days, for serious crimes as well.

Manderò il testo della PETIZIONE, come ho già fatto prima, a tutti i miei indirizzi (400), sperando che gran parte di essi facciano altrettanto. Scriverò a tutti i DEPUTATI parlamentari a cui sarà possibile farlo, e pregherò tutti i destinatari della mail a fare altrettanto. Spero così, di far pervenire qualche centinaio o migliaio di messaggi, nel PARLAMENTO EUROPEO.
Nello stesso tempo suggerisco di costituire un COMITATO di CITTADINI EUROPEI che possa essere accolto dalla COMMISSIONE PETIZIONI. Saremo pochi, all’inizio, o forse tanti, non lo so; una cosa è certa: Dobbiamo cominciare a farci SENTIRE. Siamo noi che li ELEGGIAMO, che li PAGHIAMO, quindi, siamo noi i LORO REFERENTI.
Ma come agisce l’Unione Europea? Come si puo’ dare una carica a un personaggio come Casini? Ogni sua iniziativa è repe**ente.

PS per il signor Carlo Casini: non ritengo che quanto da lei affermato (“La commissione da me presieduta non è in grado di proporre rimedi e non darà alcun seguito alla petizione ricevuta) possa corrispondere al vero. L’Italia ha già una situazione del tutto unica e particolare, nella quale vengono premiati i delinquenti, i condannati e chi pensa a fare i propri interessi senza curarsi degli altri.
Se non riusciamo a cambiare le regole in Italia, il mio augurio è che si possa regolamentare l’accesso alle maggiori cariche istituzionali nazionali e comunitarie attraverso una direttiva europea.

Apprezzo molto questo appello. Subliminale!:-) … ma vorrei porre l’attenzione su un lato tecnico, penso altrettanto importante per la divulgazione…
Il codice inserito nella textarea non mi sembra corretto… Non è che sono un esperto, ma le virgolette del tipo ” (non in uso ), andrebbero sostituite con il tipo ” (tipico del linguaggio HTML).
